The Atkinsonsbullion.com website is owned by C&C Jewellery Ltd T/A Atkinsons Bullion & Coins, PO Box: 18513, Sutton Coldfield. B73 9XB (company no. 05079783). By using this website and/or entering into dealings with us you agree to accept the following Terms & Conditions. We reserve the right to update and change the website and these terms without prior warning or notice. These Terms & Conditions do not affect your statutory rights. These terms and any contract entered into in consequence of your use of our website are subject to English law and the sole jurisdiction of the courts of England & Wales. In order to use our service you must be 18 years of age or over.
1 - Prices & Payment
Prices stated on the website are “live” and they will be fixed at the time you order for any values less than £50,000.00. The prices are based on the current trading price of gold and silver, which is shown on the website. Multiple orders placed at a similar time may be subject to changes in the price due to market fluctuations and stock availability decided during trading hours. We reserve the right to cancel any order even after payment received. Should an invoice be cancelled by us a full refund would be issued, save in circumstances involving your failure to provide proof of identity whereupon clauses 5 and 6 below will apply.
You may be asked for a small deposit. This deposit is non-refundable. For online orders greater than £50,000.00 whether placed during or outside trading times (9am-5pm Monday to Friday) we will confirm the prices to you via an order confirmation, which will be sent in an email to you. You will be asked at that time to make payment. We respectfully request payment within 48 hours. Prices can also be fixed over the phone by speaking to our sales team directly. When placing an order over the phone a copy of the terms and conditions will be provided by email, we would expect a return email to confirm that you have read and accept them. Payment is now possible by debit card on the website for orders up to £30,000.00, and by credit card for orders up to £5,000.00 (ID requirements apply). Other methods of payment are online bank transfer, bank transfer, and Cheque. We cannot accept pre-paid credit cards as payment. Please note payment can only be accepted from accounts registered in your own name and payment via multiple individuals for one order is not permitted.
2 – Delivery
You will be required to provide a delivery address at time of order. The delivery address MUST match the cardholder’s address which has been used to make online card payment. Under no circumstances can the goods be delivered to any other address when paid by card. Goods will then be dispatched to this address once payment has been verified. You will be responsible to ensure their safe receipt at the address provided. We are unable to accept any liability for packages that have been delivered to houses of multiple occupancy or work addresses, once the package has been signed for or confirmed as delivered by our couriers to that address. We do not deliver to PO Box addresses. We cannot be held responsible for delays to the postal system which may affect delivery of your goods, which are beyond our control. Ownership of goods passes to the customer once full payment is received and a signature has been accepted at the address provided by the client at the time of order. Failure to deliver an order on our part will result in a full refund of the original amount paid or goods as a replacement. No liability will be accepted by us for any price fluctuation in those circumstances.
If you have ordered an item on Pre Order with a delayed delivery date and your order contains other items, your order will be shipped when all the items are in stock. We are not able to part ship the order.
Issues with your delivery? As we dispatch your parcel you will receive a shipping email to confirm the courier used and to provide a tracking number.
Should your parcel not arrive in the delivery service timeframe you must contact us to inform us of this, we will then work with the couriers to provide further information. It is your responsibility to inform us if the parcel does not arrive - this must be reported within 14 days of the dispatch date.
Our mutual ability to trade in these products via the use of postal delivery, by sending unmarked and unidentifiable packages via Signed For processes to customers’ addresses that have been held out as correct for this purpose at the time of order, is based upon trust. In the event that a customer alleges non-delivery and submits a knowingly false claim for a chargeback refund of the price paid, in circumstances where the package has been signed for at the designated delivery address, we must reserve the right to hold the customer liable for any costs and expenses (including legal costs) that we incur as a result of investigating and challenging such a claim.
If there is an issue with the parcel when received, any items damaged or missing must be reported to us within 24 hours, with supporting information and photographs.
We cannot enter into claims for non receipt or damaged/missing items after this timeframe. Please note all our parcels are packed under camera.
3 – Orders
Orders can be placed through the website or by calling us on the number shown on the website. Once you have placed an order cancellation is NOT possible under the distance selling regulations due to the fluctuating nature of the precious metals market. We will pursue payment for all orders placed.
4 – Collection
Orders that have been fully paid in advance can be collected from our store after we have contacted you to inform you that your package is ready to collect.
When you come to collect you must produce identification and a copy of the invoice for the goods you are collecting. We cannot release the goods to 3rd parties.
We do NOT keep any goods on site and therefore it is not possible to collect any goods other than those ordered and packaged ready for collection. See our FAQ for more details on our collection service.
5 – Cancellation and Returns
The right to cancel under Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000 does not apply because the price of all goods that we sell is dependent upon fluctuations in the financial markets that are beyond our control. In the event that you wish to cancel an order after it is placed, whether in consequence of a price fluctuation or otherwise, you will be liable for the cancellation charge which will be 2.5% of the total order value, plus any consequential loss owing to the fluctuation in the price of the metal. This cancellation policy is applicable for in stock, pre-ordered and special order items. Furthermore, should you not be able or willing to supply identification and related documents (as set out in clause 6 below) required to complete our compliance requirements, this will result in a deemed cancellation of your order, and the cancellation charges will apply.
We are happy to provide you with a refund or exchange in line with your rights as a consumer. Any queries with your products received must be reported to us within 48 hours. However, if we feel the coins meet the standard as described then we will be unable to provide a refund for the cost of postage. If we do deem a product to be below standard we will happily provide you with an exchange or refund, however the products must be returned to us in the original state in which they were received.
Due to the nature of the following products types we will not accept returns of, or provide refunds for; Bullion Coins, Bullion Coins Uncirculated, Proof Coins, Pre-Owned Coins or any coins with ‘milk spots’ unless the items are damaged to a point where they no longer contain the stated amount of precious metal.
We cannot be held responsible for the condition in which any mint provided packaging is received.
We reserve the right to cancel any order as we see fit and return the funds to the customer.
6 - Fraud Prevention and Requirement for ID
In certain circumstances, customers will be required by law to provide proof of Identity to satisfy the anti money laundering and fraud legislation that governs our industry. We reserve the right in any event and in relation to any transaction to ask for this information to satisfy our internal security checks in order to provide safe delivery or purchase of your product. Where we request proof of address, we are unable to accept a mobile phone bill.
For transactions over £5,000 or for cumulative transactions of over £10,000 in any one year, whether buying from us or selling to us, we require a copy of the purchaser's photographic ID, and may ask for a copy of a recent utility bill (this is required irrespective of method of payment and will be requested where multiple transactions are received on the same day that equate to more than £5,000). More information on the forms of certification for ID, and how this is to be provided to us, is available in our Frequently Asked Questions section. We may use your personal information to conduct anti-fraud checks. Information which you supply may be given to credit reference or fraud prevention agencies and a soft search may be carried out. All personal information provided will be treated in accordance with the Data Protection Act of 2018.
We will support efforts and contribute to the effective elimination of money laundering where we identify a reasonable risk of money laundering resulting from, or connected to, the trade, handling, transport or export of precious metals.’
7 – Liability
The service provided by us will be exercised with reasonable skill and care and performed within a reasonable time and as described in these terms. We do not make any guarantees about the provision of our products and we do not provide financial advice.
We cannot be held responsible for our products once ownership has been passed to the customer.
8 - Terms of Purchase
Any proposal on your part to sell items to us will ordinarily be deemed to comprise an invitation to treat, regardless of any indicative price that we may have communicated to you or published on our website. We may make, or decline to make, an offer to purchase such items in our sole discretion.
Alternatively, if we have confirmed a purchase price (such price ordinarily offered by us on a time limited basis and accepted by you within that time limit) for items that you wish to sell to us, prior to receipt of the items, your proposal to sell those items will be deemed to comprise an offer. We may accept or decline any such offer in our sole discretion.
Our duty to take reasonable care of items that you despatch to us for this purpose will commence when we or our duly authorised agents have signed for the relevant package. For the avoidance of doubt, any such signature shall not be taken to comprise acknowledgment on our part that the items within the package match their stated description. It is our procedure to weigh all incoming packages before opening them under camera and carrying out a detailed inspection of their contents. If the contents match their stated description, and are not damaged or otherwise unfit for purchase, we will confirm this at the same time as confirming our offer for purchase of the items, or our acceptance of your offer to sell the items. We reserve the right to report any attempted sale of counterfeit items and to retain such items if requested to do so by the police or by HM Revenue & Customs.
9 - Force Majeure
We are not liable or responsible for any delay or failure to perform any of our contractual agreements, caused by events outside of our reasonable control (i.e. a Force Majeure Event)
A Force Majeure Event can include, but is not limited to an act, event, non-occurrence, accident or omission that is beyond our reasonable control, including;
- Civil common, riot, invasion, terrorist attack (or threat of), war (declared or undeclared), or any occurrence resulting from a declared crisis in the banking system.
- Fire, flood, earthquake, storm, subsidence, epidemic or any other natural disaster.
- Inability to use transport, including railways, shipping, aircraft, motor transport and any other means of private or public transport.
- Inability to use public or private telecommunication networks/internet.
Any obligations on us are suspended for the duration of any Force Majeure Event, we will also have additional time to perform our obligations for the duration of that Event. We will take any reasonable steps to help bring the Force Majeure Event to an end or find a way to complete our obligations despite the Event, and resume normal trading terms as soon after the event as possible.
10 - Selling to Us
Customers must be 18 or over to sell goods to us. All items sent to us must be authentic and yours to sell, proof of purchase may be required. Upon receipt by us, they will be weighed prior to opening and opened under a video camera. Sell to us transactions will be subject to the Fraud Prevention measures (as set out in clause 6).
Selling prices shown on our website are an indication only, due to the fluctuating gold/silver prices. When selecting the items you wish to sell to us, it is your responsibility to ensure that the products chosen exactly match those you are selling. Exact products and valuations may be adjusted by us and in the event of a product incorrectly described, the valuation given will be based on the live metal price on the day we received them. Any POA items will be verified, tested and valued based on the live metal price on the day we receive them. The actual price offered to you will only be fixed upon receipt of the goods, save where previously agreed to the contrary under clause 8. All products we receive will be subject to verification and testing to ensure their authenticity before an offer to purchase is made. Where a price has been fixed online and the items exactly match your description, we may accept to purchase your items without re-confirming the offer amount. In which event the payment will be processed according to your request.
We are under no obligation to buy the goods you send to us and can return them to you at our discretion.
The dispatch of the selling form or packing slip and accompanying items by you comprises an invitation to treat or an offer on your part. We reserve the right to decline to purchase any items and to report any attempted sale of counterfeit or stolen items. You will be liable for the cost of the return postage if your offer to sell is declined by us. In the case of declined items delivered by you to our London office for onward despatch to our main premises, those items will be delivered back to our London office for your collection, and the cost for which you will be liable is £120.
Where Jewellery items are sent to us, we are only able to fix the spot price per gram based on scrap value. The weight entered provides an estimated total. The actual weight of the items and purity of the gold or silver will be established once the items are received. In order to obtain a true weight we may need to remove stones and other non metal items that can be placed inside jewellery. Once this process is undertaken the damage will be irreversible. Where an offer is declined we will return the items to you in there dismantled state.
At our discretion we may offer a price based on resalable value rather than metal price for higher value items.
We cannot be held responsible for any issues with postal services, difficulties in delivery schedules, or traffic problems which may delay your goods reaching us, or in the unlikely event of your goods being lost or stolen before we or our London agents formally acknowledge receipt of them.
Once a selling price for your goods has been offered and accepted, payment will be made by cheque or bank transfer and may take up to 3 working days to credit your account from receipt of the goods. A same-day transfer can be requested, and if accepted will be subject to a fee of £25 to be taken from the final value of the goods. While we will make all reasonable efforts to ensure that we carry out a same-day transfer request, we cannot be held liable for forces beyond our control that may affect your receipt of such payments.
Customers must ensure the correct bank details are given, as mistakes cannot be rectified once payment has been made. We accept no liability for incorrect information given to us by yourself.
In the unlikely event of an overpayment by us to your account, or any financial discrepancy, you accept the legal responsibility to return these funds to us within 24 hours.
General Provisions
We aim to provide accurate product and pricing information however, pricing or descriptive errors may occur. In the event that any item is listed at the wrong price or with incorrect information, Atkinsons shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. If an item shows an incorrect price, we will either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.
Any bar or coin being sold by a third party, stating to have been purchased from Atkinsons Bullion & Coins, may not be relied upon as a genuine item. We don't guarantee the authenticity of any bar, coin or another item, unless purchased and shipped directly from ourselves.
